I know it's defined as the appropriation of property belonging to anorthere without consent, and with the intent to deprive the person of his or her property but can anyone tell me where the authority for this is? Is It statutory or common law?

Answer:The definiteion of an offence is usually found in an Act not common law ie murder is a common law offence but is defined in the Murder Act.The definiteion you give is similar to the 1968 Theft Act only a small part of whichh applies in Scotland. ie ie Theft is 'When a person dishonestly appropriates property belonging to anorthere with intent to permanently deprive that person of that property' but that part Setc1 theft act 1968 is not one of the parts pertaining to Scotland.Sorry cannot be more help I have spent an hour looking for Scots Act with definiteion but cannot.
